THESE HOSTING RULES ARE IN EFFECT THE MINUTE HOSTING IS DELIVERED TO THE CLIENT.

These rules are to be read, understood and agreed to BEFORE you get your account. If you can not agree to these terms or abide by them, please look for hosting else where. There will be no variation of these rules. Everyone will abide by the same set. The rules for hosting are as follows:

1) ONLY 1 hosting account per person. If you are found to have 2 one will be suspended at staff discretion until things are worked out.

2.) No pornographic material of ANY kind. If it is found on your account you will be terminated; no refunds, no backup.

3.) No copyrighted material of ANY kind. If this is found and you can not produce sufficient proof that you have permission to display or use it, your hosting account will be suspended until the matter is cleared up.

4.) No file sharing sites will be allowed. This only promotes unwanted copyrighted material, pornography and to much bandwidth usage. If this is found your hosting account will be suspended until all files and graphics are removed and your site format changed. If you do not comply; hosting will be revoked without refund.

5.) No proxies of ANY kind shall be on your account or attached to it in anyway. If this is found your hosting account will be suspended until further investigation and then we will decide what the appropriate action is to take. This could result in removal of the proxy and continuation of hosting services or termination without refund.

6.) Any account that has been placed on suspension and not claimed after 6 weeks will be terminated. We DO NOT take backups before termination.

7.) Any account to be found inactive (meaning no site at all has been made)  will be terminated after that months payment has run out, unless prior arrangements have been made with Hosting Admins. No backup will be taken before termination.

(Back ups are your responsibility)

NOTE:

If your site has been terminated due to failure on your part to comply with the hosting rules, this site and/or it's administration reserves the right to keep any/all monies received from you (the client) without any refund what so ever. If you (the client) cancel your account you will be entitled to a refund based on price and amount of time in that month used.


Furthermore:

The client agrees that it shall defend, indemnify, save and hold www.pctweakr.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against www.pctweakr.com,its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless www.pctweakr.com against liabilities arising out of;

1.)Any injury to person or property caused by any products sold or otherwise distributed in connection with P.C. Tweakr Hosting or servers.

2.) Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.

3.) Copyright infringement and

4.) Any defective products sold to customer from www.pctweakr.com hosting clients or it's servers.

High Resources:

Resources are defined as bandwidth and/or processor utilization. P.C. Tweakr will discontinue services to your account in the way of a suspension if this is found to be happening. Continuation of services will continue when a reasonable agreement of payment can be reached for the resources used above what is allocated to the clients account. (All resources over and above what has been allocated to the client must be resolved in a monetary fashion,(depending on situation)

Refunds:

Refunds will ONLY be given if the rules during the clients hosting period have NOT been breached in ANY way. If they have not been breached then a refund will be given on the basis of payment made and time used in that month.

P.C. Tweakr will not be responsible for any damages your business may suffer. P.C. Tweakr makes no warranties of any kind, expressed or implied for services we provide. P.C. Tweakr disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by P.C. Tweakr and its employees.The administration of this site reserves the right to change these rules at any time.
